A Mandamus Hearing is applied for when a litigant believes that the trial judge has made a serious error in law. In all the motions filed in The SCO Group v. IBM, which was a hard fought case, or Apple v. Samsung, another hard fought case, we never once saw an application for Mandamus. Here's a filing in a case where a Mandamus application was filed. It makes fascinating reading. www.scribd.com/mobile/doc/213048319Wayne madhatter.ca

I doubt that the judge will have missed the fact that the Mandamus request was barking up every tree in the hemisphere, but it's still good to leave him grinning when he puts down your response.

I doubt that the judge will have missed the fact that the Mandamus request was barking up every tree in the hemisphere, but it's still good to leave him grinning when he puts down your response. I saw that too, and got a good chuckle out of it. My first thought, though, was "I wonder if the judge'll get it..." But then if he doesn't his clerk will (and so on, down the line), and their chuckles will have him asking "What's so funny?"
