Techdirt have an interesting piece about Alice v. CLS Bank and their software patents dispute appearing before the Supreme Court. Here's Hoping The Supreme Court Does Not Blow Another Opportunity To Fix The Software Patent ProblemThe article points toward the oral hearing which makes interesting reading. The judges ask all sorts of information about how the escrow trading system suddenly becomes a wonderful, new patentable invention when the trade is stopped on-a-computer rather than by your mum, an elevator operator or King Tut. It seems that there is a hope that the Supreme Court will not just review the patent in question for abstract ideas being patented as they did in Bilski, but will provide more general rules on the patenting of abstract ideas on-a-computer.
