This will be interesting - all of Microsoft and Apple's arguments in the Standard Essential Patents when fighting Samsung et al will be hung directly in their face.

Ah, and now for the blowback. What exactly is Google/Motorola going to do? In OEM vs OEM cases, you can file a counter-complaint. That won't work directly with the misleadingly named "Rockstar" since it isn't an OEM. Of course suits could be laid against the OEMs, in the hope of pressuring Microsoft, Apple, etc. into getting Rockstar to back off. But that isn't likely to work, since all those companies have lots of cash, and could fight for a long time. What might work better would be to drive Rockstar into bankruptcy... I've done a series of searches on Rockstar, specifically to look at their financials. The lack of information is fascinating. The company is headquartered in Canada, but doesn't appear to be a registered with the Government of Canada. There is one filing with the SEC, but it is a minor one. It is possible that the company is registered with the Province of Ontario, however the online system that the Ontario Government has sucks, So we don't know how well financed Rockstar is. Another option is as mentioned above, trying to disable the patents. Since there are thousands of them, this could be problematic. I'm going to look into things during the working week. Since Blackberry is part of the consortium, what rights to the Rockstar patents would a buyer have? Do we know if there is something in the Nortel/Rockstar agreement which would prevent a buyer of Blackberry from gaining immunity? Could a consortium of Samsung/Google/HTC gain access tot he patents by buying Blackberry?

Wasn't the primary reason the patents were allowed to be sold was that they couldn't be explicitly used to attack or block competitors from using them?

Google and Smasung aren't competitors to Rockstar - Rockstar is in the business of trolling with the patents whereas Google and Samsung are in the business of making products for consumers.
